No, they are doing the right thing and taking someone they think has broken the law to court and will attempt to prove he broke the law.

If they got 8,500 IP addresses that they thought kinda may be BP's and sent them all a letter saying GIVE ME MONEY OR ELSE, then that would be extorting money.
