I'd prefer to see them both gone. The problem is, no one has yet found the true Achilles Heel for the tubes, but it was found for the lockers, so that is currently where the focus is.
Tubes are not easy because so long as the comply with DMCA, which is removing the content when they get the notice, they get a legal pass for now. Someone has to find another crack to break their back. However, there are a few possibilities that I'm not going to discuss here that may cause some problems for some smaller guys. But the big boys have covered their asses very well. That said, everyone makes mistakes.
No one is going to sue them because most of the people who are in a position to sue them have tubes of their own, or are just wanting a settlement. So if you want to do something about tubes, you have to find another way. But as it stands, they are within the law so long as they don't get caught uploading the content. But even if they do, who is going to sue them? Pink Visual again? Settlement. Since no one has gone the distance in a law suit and set a real precedent, this is where we stand. But all it takes is one company to do that and win, and it's game on.
