Babeu calls Obama's mandate 'roadside amnesty'

FLORENCE, AZ (CBS5) -

Pinal County Sheriff Paul Babeu is calling President Barack Obama's new immigration policy "roadside amnesty."

Babeu said one of his deputies recently pulled over a 17-year-old undocumented immigrant and Immigration and Customs Enforcement let him go.

On June 27, the 17-year-old was caught speeding 50 miles above the speed limit in Pinal County near Merrill Ranch Parkway and Felix Road. The teenager told the deputy he was speeding because he was late for work.

"He (the driver) says he doesn't have a driver's license and when asked why, he says, 'I can't get one, I'm illegal and I can't get any of the documents in order to qualify to get an Arizona driver's license,'" Babeu said.

Babeu blamed Obama's recent mandate for his deputy letting the undocumented immigrant go free. He said the president's mandate, where if the person is under the age of 30 and has been here for more than five years, and has no felonies, ICE will not prioritize their deportation, meaning, they stay in the U.S.

The Department of Homeland Security on Monday issued this response to Babeu's statement:

"Department of Homeland Security (DHS) officials in Arizona have been directed not to respond to requests from state and local police officers for assistance in enforcing immigration laws unless the individual or individuals in question meet DHS' enforcement priorities. Those priorities include convicted criminals, individuals who have previously been removed from the United States and recent border crossers."

"For the president to do this - when he makes the good guys out to be the bad guys in law enforcement - we are the ones who racially profile," Babeu said. "And then, with the wave of the hand he says we are not going to enforce the law on these individuals, that is not OK."

In the interview with Babeu, he also mentioned 287G, the federal mandate that gave Arizona law enforcement the right to enforce immigration law and that was taken away by the Obama Administration on the day of the SB 1070 Supreme Court decision.
