Gotcha, it all makes sense now, why they are not going after the big boys.
Thanks for clarifying Embedding VS Hosting the actual content
It doesn't matter, if you do your biz in the US, you're at Risk...

So what did we learn here kids? If your domain and servers are purchased and hosted out of the US then you can't be subjected to US law. OR how Xhamster was able to legally laugh at them when they tried. Matter of fact, the case I read showed the owners of Xhamster fucking with FRASERSIDE and made them file numerous re-writes of the suit, as they later found out this could do little.
Xhamster figured out how to grind them down, spending a lot of their own time and resources just to be fruitless in the end. Actually, it's kind of smart because it's FRASERSIDE own game and after reading this:
Meaning, FRASERSIDE is going after all the US based tubes that embed the larger foreign tubes movies because FRASERSIDE does NOT want to wast their resources in lengthy and expensive foreign court proceedings. In short, there are thousand of US based adult tube sites that link off/to the larger foreign tubes.
Going after BP and to make an example out of him will send a clear sign to others, they are also vulnerable. OR another way for the larger foreign tubes to lose traffic and backlinks because they are losing third US party smaller traffic tube feeders ie., free traffic generators.
If BP capitulates, the smart thing to do, FRASERSIDE took down a well known player in the industry and will use him as a poster boy. If BP fights this they will grind him down because FRASERSIDE filed in Federal court as this could take years and incredibly expensive if this goes to trial, even more expensive if he loses and he will lose.
Honestly, could you NOT pick a better person then BP to go after? He spent over a decade branding himself in this business and very successful at it. It's a total win-win for FRASERSIDE because BP has already changed his sites (see above) and sure all of the family have done the same. This also proves/felt he's done something wrong to comply.
The jury will be smart enough to understand he was making money from a content source that was not his as the jury members will be old ladies or worse, blue collar workers who've been fucked before on cross sales. In short, the total subject is too complicated for anyone outside of the business to understand. Also this is a civil and not a criminal trial so you'll just need the majority to lose.
