The focus shouldn't be on the criminal but on the victim. The criminal who refuses to voluntarily repair (or pay for the repair of) the damage he caused to a victim's property should be forced to repair that damage or pay for the repairs (or replacement). He should be forced to pay compensation for the time, resources and opportunities the victim lost because of the criminal acts he committed.

The prime focus should be on that. On making the victim "whole again".
