The answer depends on the contract. If the contract contains a conditional release of intellectual property rights, a DMCA takedown may work. When you say that the credit card company will not budge on the chargeback, what do you mean? There should be a dispute resolution policy that allows you to submit evidence in support of the charge. Be warned, however, credit card companies favor the card holder and the dispute resolution process can take up to 6 months. You may want to try a threat letter/DMCA hybrid approach.
