Seems to be a pretty weak argument on ICM's part. I'm not an attorney but encouraging people to boycott a product where the alleged "why" is the very thin argument that it was to maintain a monopoly on traffic/users etc, is not a very good argument that will hold up as it would then have to be proven that registering a .xxx domain at a retarded cost would somehow post some immediate benefits to the registrant at the direct cost of Manwin et al. Further, it seems pretty easy to prove they have little to zero industry support, were aware of it and couldn't have possibly have had any reasonable expectations of decent numbers of people registering .xxx domains. Given the basic tactics of ICM and their whole "blackmail-like" tactic of "you need to register it before someone fucks you", I would be wanting to stay out of court as that is the obvious counterargument - which when uncovered, detailed and examined is certain to lead to, or at least places them at great risk futher lawsuits.
