The Justice Department of the UNITED STATES of AMERICA came after the guy THREE times, until a conviction was obtained. Eric Holder's position is part of the Executive branch of the government of the UNITED STATES and the head of the Executive branch is of course, none other than President Barack Hussein Obama, who could have simply made a phone call and told Holder to drop the thing had the President any real interest in doing so.
