It depends on the nature of the patent. In civil cases, it is 51% to win. Even a provisional patent is stronger than nothing. A full patent and you can tie opposing party up for as long as you need regardless of what they have.

Yes, file yourself electronically, and call the USTPO (use the number on your application) and they'll help you.

I'm assuming this is not at engineering, chemical, process, or other complex patent.
