I'm pretty sure that "being a smart ass", is not an illegal offense, nor does it qualify you to get a ticket, let alone be tackled and handcuffed and arrested.
Cops are not simply allowed to arrest people that piss them off. They are not little gods.... although lately they seem to have started to get that attitude.
