Never used the program, don't know the people, but I do know as an independent affiliate that a TOS is generally written as a long form of "we can terminate you if we feel it's in our best interest" and that, as they say, is that.
I mean just look at the sections that describe ways you may promote in many TOS's. The short form of that is "you must ask us if it's OK to promote us in any way." and again, this is not picking on any one company, read your TOS' people. It's incumbent upon the affiliate to check TOS for changes as well.. what applies today may not apply later today.
