of course your fees will magically eat up all your $, but they won't know about it until later on. seems like the standard time-buy, kick the can down the road explanation, and hope you give up on your $.
i'd hire a lawyer, send a certified letter demanding proof, and CC the card associations on the letter, especially if they were controlling the pay pages the entire time (they were managing the pay process).
without taking sides of what actually happened, failure to communicate on the side of the processor is always an epic fail, and it's a played-out move. i wouldn't hesitate- get legal on it, let them know you mean business and you aren't going away. at a minimum, you'll get information if they aren't answering you.
