I think that depends on the contract and terms he had with the company. I have worked for companies in the past that forced you to sign something that said any inventions you may come up with or anything you might develop they have the right to claim since you work for them. Still, there were several guys that freelanced and did software development on their own.
Since he made it to work for this specific company they might claim it, but he could change it a little, alter the name of it and rebrand it as something else he would probably be in the clear. Especially if he can prove that he didn't develop it while on the company clock.
