I am sure the reason they are using to justify the arrest is the " inciting " laws that the city/state has. Its pretty obvious there are plenty of people watching the situation and that is something that can get out of hand really really fast putting the cops in an even worse position.
Its hard to tell from the video if the cops told the guy to move on or not as you really can not hear them. if they did and he refused and wanted to turn it into a racial thing which he seems to have wanted to by his statement about not having a black cop on the scene He was pushing them into a situation where they had to get him out of the area. either to leave on his own or put him in a police car so no one could hear him any more to diffuse any situation he was creating.
should they have arrested him? hard to say. Should he have just left? yep bet your ass he should have.
