The fact if the wiretap was not decided not on. The court instead made the bar so high that its next to impossible for anyone to challenge of f the FICA courts and NSA wiretaps are legal.
That does not mean the secrecy courts or warrantless wiretaps are legal. Just that the court is making t next to impossible for anyone to bring a case against it.
Sad that someone that claims to be a supporter of this countries constitution is more than willing to toss away the bill of rights.
