Welcome to gfy! Will try to help you out with some straight forward responses here.
1) What you are in need of is a tube script. The Mechbunny tube script is considered one of the best.

2) The stream protection you speak of would be something that you could have done custom for your script but you will likely need to hire someone to code it for you unless you posses those skills.
3) You say you don't have copyright to your content which essentially means that it does not belong to you. It is a best practice to have records for all content on any adult site you have. In the footer of most adult sites you will find a link to "2257" and that helps users, government etc. know that your performers are 18 years of age or older and that you have rights to display the content.
4) If you choose to make your site a pay site where members pay a monthly fee for access to your content then you will need to setup a billing processor such as
CCBill or
Zombaio
5) Deciding to make your tube a paysite vs. a free site is entirely up to you. It is very difficult this day in age to get people to signup for a monthly fee due to all the free tubes that are already out there. But if your content is unique as you say then you have a greater chance of obtaining and retaining those members. Going with the free tube you will need to make sure you choose affiliate programs with ads and sites that are appealing to your viewers.
Finally you should know that just because you build a tube site, paysite or free, does not mean that you automatically will have people on your site. You will need to generate traffic to your site. Generating traffic is often the #1 problem for new comers and is imperative to the success of your site.
