That's not true at all. I can think of many reasons why it would be illegal.
Interfering with a police investigation is one. Harressment - I'm thinking paparazzi here - is another. Taking photos of an illegal act might make you make you a conspirator and part of the crime itself. If you take a picture of a minor getting fucked in the park, it's in a public place but it's surely not legal. If you stand on the street and take a picture of someone naked through a window engaging in a sex act and then post it or sell it, that might not be legal either.
I haven't watched the video and I'm not about to - I am a bit busy this morning. But from what I've read in the posts it seems like the police were notifying someone a family member had been hurt - a private, confidential, and potentially emotionally upsetting moment.
It's simple: Be a douchebag and you will be treated as such. It might be legal for someone to stand on the sidewalk, but if the police want to fuck with you they will and can - you can be standing on the street, the police can decide your actions are suspicious, search you, question, then arrest you on some stupid charge just to fuck up your afternoon.
Reminds me of that group of people that wanted to "dance" at the National Monument in Washington DC. No, it's not illegal to dance, but when you are making dozens of other tourists nervous... They will find something to charge you with arrest you and harress you.
