Just add a big red notice when they submit comments that states comments will be removed and users banned if bla bla bla (illegal, offensive etc.)
Sure there's a lot of sites out there that seem to be getting away with it but they either don't bill or they got their approval first and then started rolling the dice on user contributions. Also, they are probably the reason you are being scrutinized more carefully than in the past.
