He says he saw the end of a shotgun, but none was found. Had authorities located one in the car he may have been found not guilty, if charged at all.
The police fire at cars driving away all the time. They also shoot fleeing gunmen in the back. Theory being, the gunman has already made a threat to end a life and he must be taken out rather than allowed to get into position to kill. Now this concept is gaining momentum in cases not involving cops. But firing into a car where no gun was found is pretty tough to defend and all things considered (mentioned by the mainstream media anyway) it appears as though he was looking for trouble.
One of the guys in the car could hypothetically have disposed of a shotgun before authorities arrived. I'm not familiar enough with the case to say whether that is possible or not though.
