Yes, I am stating you can't use it.
People used to think they could download tons of content from newsgroups and use those pictures to make adult websites. There defense was they got the pictures from a public location.
Well, doesn't hold up...and as I am sure many content providers and webmasters can tell you...they will win in court.
If you don't have direct permission from the person who owns the pictures, you cannot use them even if you got them from a newsgroup, a forum, etc....
