The problem with revenge porn laws

Many countries are planning on revenge porn laws.

But there are a few problems.

Who uploaded the pics?

An angry girlfriend or boyfriend could simply upload pics of themselves to the web, then claim there boyfriend or girlfriend posted them. We have seen people make false rape claims as a way to get revenge, so one could imagine people would do this to get there boyfriend or girlfriend in trouble with the police.

It may be possible to trace the origins of the pics, but this could be costly to do. Also while it may even trace back to the pc they were posted from, this would not show who indeed posted them as anyone could access the pc.

And will people simply admit guilt (when innocent) to avoid going to prison or/and having to go to court.

Legitimately posted.

Sites such as watchersweb.com have for many years had people posting pics of peoples girlfriends and boyfriends with consent. What it later they split up. Then one of them to get revenge claims no consent was given.

Public nudity.

In the UK I believe (I may be wrong) that you can take pics of anyone in a public place without consent. So if someone is nude (say on a nude bike ride) and is photographed then pics posted on the web, will this become criminal?
