Yeah, I am not sure how it works with intangibles. That is the problem with the current law as it pertains to non tangibles or the flow of information being patentable... Maybe they went after them for encouraging infringement by encouraging US affiliates to sign up. Just seems since they are a Canadian company using servers outside the states, they could get around it if the patent only existed in the states.
