Simple solution. If he was doing this on his own and not by order of the company he worked for suspend him without pay for 30 days. When he comes back, if he does it again remove him from the job, or make the fines so severe that companies do pay attention to them. If it is a company thing and they are telling the employees to do this then either fine them heavily or just take the contract from them.
To me putting someone in jail should be a last resort. Our country is becoming one where our first response to anything is just throwing them in jail.
