That's pretty much a normal human function and the only reason they chose that spot is the wall hides them from indecent exposure.
They are actually trying not to break the law.

In bigger cities most businesses will not have a customer bathroom and even when they have one they will not let anyone who isn't "buying" use it.
There is no "public restroom".

If you plan on taking a long walk in NY city then you better take enough money to buy a drink or a meal if you need to use the restroom.
