Well, it is a fine line and I can totally understand your frustration. In the end tho, it is (mostly) opinion. You can do what Harmon suggested, or what it appears you are doing now. You can keep escalating it (host, lawyer, etc) and see how far it goes.
My point about traffic meant the site's traffic might be so tiny that the actual 'damage' to you could be minimal.
