I'm surprised they haven't immediately appealed, although they have time to consider the judgement - it will be interesting to see how this unfolds.
I think Cloudflare could have avoided all this by establishing a procedure to allow rights holders to identify infringers and their originating server infrastructure.
On one hand Cloudflare says it is just a pass through service, however on the other they refuse to assist those who are investigating or prosecuting civil actions against their clients.
If they are just a pass through service, why then can't they be cooperative with legal action rather than digging their heels in to protect the infringers ?
Nobody is really interested in Cloudflare per se, the interest is really with the originating host of the service or site as that's who will need to shut down the infringers anyway.
