I would have argued that the people watching could have looked the other way, even though that would appear to be an argument from ignorance to a jury. Just give me 20 minutes and they would see my point. America is way too prude!
It wouldn't surprise me if the same Prosecutor had just made a plea deal with a murder the day before offering a reduced sentence of 7-10yrs.
That is how FUCKED up American Law is today.
