Whereas a if a person kills another, with the intent to kill simply because the other person is black (or whatever race), then that is classical murder...with the added degree of hate for an entire race of people. So the punsihment is more.
So as you can see, punishment for killing another person is never equal across the board. The INTENT of the killer is a key factor in determining punishment.

but thats why they are charged with lesser crimes capital murder is capital murder regardless of the intent
