It is entirely possible that CA law (which would might not recognize his CCP) is still in compliance with the 14th Amendment.
It's just like if a state did not recognize marriage whatsoever...that would be legal since marriage power is reserved for the States. And thus that state would not have to recognize same sex marriage. It's only if the State chooses to recognize marriage, then it must recognize both gay and straight marriage.
