It's not illegal for her to have government emails on her server. In fact, it's a rather common practice. She was not the first Sect Of State to do so, and others have done it too.
Also, I don't believe it is illegal for her to delete the emails from her server. The law doesn't say "illegal to delete" but instead that there must be a copy preserved. Being as this was an official email address it went through government servers, and multiple copies should exist. It also shouldn't be required of the end user to keep copies of said emails, but instead the department to ensure proper records are kept.
Sorry, this is nothing but another Republican witch hunt to make Clinton look bad. Of course we'll have to roll out investigation number fourteen into Benghazi too before the election.
