Banks also do not like it when it is most obvious the service was not used and the charges were not authorized (they simply don't even care that much about the terms). A second chargeback by Visa (called arbitration apparently), will say from issuing bank:
"Ch bank has reviewed & maintains unauthorized. For a non face-to-face sale, the only Visa approved remedy to a c/b for CH did not authorize, is to prove sale was Verified by Visa."
It may take a second chargeback, but he will win. That is unless he doesn't chargeback and emails choopa a few more times. And I think the time frame from filing initial chargeback to date of sale is 120 days. So 4 months back from date of filing is typically the accepted term, however those dates seem to change depending on the issuing bank.
