I really doubt any judge would be sympathetic to a scammer affiliate crying in court that his affiliate stole his content. Well if they didn't scam their affiliates and running away with their money, they wouldn't have those same affiliates scamming them back by stealing their content.
In the case of my client, he made the money he was owed from the memberships he sold with the content he downloaded. Threats from the original owner has gone no where as many of you might expect. When a program owner consciously decides that they are going to rip off their affiliates, they are (1) without honor because there is a right way of doing business and the wrong way, they could have paid their affiliates instead of going into the wind. They chose the scumbag way, so no sympathy from me what happens to their content. (2) Most likely, they obviously don't have the financial means to pursue a protracted legal matter against the affiliate for stolen content, they might as well cut their loses and accept it.
So for all you programs thinking of or ripping off your affiliates and disappearing, it's a good reminder that there are always consequences for your actions, even in porn.
Don't want to see your content stolen? Then pay your fucking affiliates what they are owed.
