He asked one couple after the fact. Is that truly an accurate sampling of data? I mean enough to use it to win in court? What if they had a different server? Did he ask any other black people if they were asked to prepay? Did he ask any other white people? Spanish? Asian? Arab, or Indian? Did the boss really force it or was that something she was saying just to add authority to her decision?

I worked as a server and bartender in college and I never in my life ever seen black people dine and dash. I'm not saying they don't, it just doesn't seem like something that fits a certain stereotype for them.
