If this guy wasn't a total psycho he would have told the waitress to fuck off and walked on the check -- that would be the rational thing to do or just go outside and finish the cigarette.

Had the waitress been smart she would have just told the customer that he could step out and finish his cigarette. Even if he had walked out and stiffed her on the check -- she might not have ended up with her brains splattered on the floor. Certainly not worth enforcing the law as her job was as a waitress.

On the other hand whatever she said might have set this psycho off ...
