Shit like this is what happens when you pass no-smoking legislation - with no way of really enforcing the law other than placing responsibility on the untrained, unequipped and unprepared general public.
The waitress was caught in a no-win situation. She's been told about the law, her manager has likely made it part of her job responsibility to deal with smoking patrons...yet she's in no position of actual authority to enforce anything. Caught between the proverbial rock and a hard place.
