Trump didn't say it was "tempting + ["you have] to take out their families" either -- did he? It was a direct threat ...
But both statements are really the same -- death threats ... So when are indiscriminate death threats OK toward groups of people? The question is rhetorical ... or at least should be

First: What the fuck does Trump have to do with this?
Second: It's not "hypothetically speaking"... she was expressing her feelings... When i say: "you are acting so annoying that i'm tempted to take a shit on your face". What does that say? Something like: according to my feelings i could or would want to take a shit on your face.... but, for a variety of reasons, i'm not going to. If i really had the intention to do it I would have said: "i am going to take a shit on your face" or: i just would have done it.
So when i see a car with no one in it with a running engine and open door and i say "it's tempting to walk over there step in and drive away" I will be arrested for attempt of grand theft auto?

In this case i think the woman was actually so smart to NOT make a treath by specificly saying "it's tempting". It's just too sad for her your law enforcement is often beyond the understanding of these nuances....
Any good lawyer will just demolish an indictment like that... owh no wait... you have jury trials
