I hate watching shit like that. Why not consider what's best for the child, and use that as a tool for judgement? Not some outdated, "She's 1/5th Native American" bullshit guideline. So what now? She gets bounced to a shitty foster home with abusive parents? That shit pisses me off on a personal level. Common sense should prevail in cases like this.
