It's possible. He already lost the first round and a judge approved the extradition, now he is appealing it. If he loses that I suppose he could ask the government not to extradite him, but the New Zealand government has worked with the US government during this entire case so I have a feeling they would send him as opposed to deal with all the potential legal issues that could pop up.
Personally, I think he will lose the appeal and then try to run to somewhere with no US extradition. I don't know if he will make it there, but I think he will try.
