It won't pass. Breathing Nitrogen GAS (Not liquid Nitrogen, crucifissio, Lol! (Cool idea though)) won't fly legally because it's too slow. It doesn't hurt the felon directly, but it starves him of oxygen. He would pass out first and then eventually die of asphyxia about 15 minutes later.
He would probably suffer lots of convulsions too as his body and lungs tried harder and harder to grab every last oxygen molecule it could.
Not to be sick, but to me the fastest possible way to do the job is the best.
