If registered and qualifying trademark holders who did not obtain a SMD and pay the fee to reserve their trademark to the registry for the new gTLDs
What is a SMD file? | www.trademark-clearinghouse.com
the trademark holder can buy his name on the open market or sue the registrant in URS Arbitration https://newgtlds.icann.org/en/applicants/urs that is the ICANN 'law'.

domain extensions in a trademark name are not good for a SMD cert.
