Again intent; If a sitting president leased the state of New Hampshire to an oil sheik for $5 billion a year and put the money in his numbered swiss bank account -- that would be illegal -- extreme example but very clear.
Trump is making real mistakes that will bite back in the end -- give it time.

But a reasonable argument could be made that it is a continuing activity, started prior to Comrade Trump taking office. (lawful then, not lawful now)
