Over the years in San Diego I've shot everything from new recruits to Navy Seals, to special intelligence officers etc. and often higher command knows and has no issue, it's when someone reports it to get revenge that things go downhill, because then it's on record and people have to act on it.

You do realize that all military personnel don't adhere to the same constitutional laws and don't have the protections citizens do? They give that right up, they don't even have the right to a trial by jury. They are governed by the UCMJ which is MUCH harsher than anything in the laws we're used to. Yes it is against DOD policy to engage in that behavior, just like the secret service agents that got fired nailing columbian hookers. A military person can be grabbed for no reason by an MP thrown in the brig for however long for whatever reason, they don't get a trial, they get a small tribunal of higher officers. You sign on the dotted line you really do sign away your rights in that way.
