Generally speaking the vessel approaching the starboard side has the right of way... unless their are other factors (restricted by draft, fishing gear down etc). So, at first glance, its not good that they were struck by another vessel on the starboard side as they would be required to yield to the approaching vessel. Of course, it goes without saying that there was a colossal fuckup in communication between the two vessels considering both the safety and navigation protocols and rules and the number of people on the bridge of each vessel.
