I'm not disagreeing with you. Of course it should be disclosed, but like most companies, they might disclose that in their TOS somewhere. What I said above was to make this a FEATURE in their OS that could be easily turned off if users wanted to.

They could be bullshitting, yes, but I wouldn't call this PR. They didn't make a big commercial or giant ad anywhere. This is just their response.

Maybe, maybe not.
My point is this. If the routine in their OS does what its supposed to do and extend battery life in older phones, then ok. But if the cost of this reduces performance, then users should have the ability to disable it. Am I wrong?
