Publishing false information and Publishing false information with the intent of causing harm are 2 totally different things.
It is still not a crime though. In the U.S. libel and defamation are NOT crimes. You have to sue over defamation and libel, they are not handled in criminal courts. It is a civil offense usually, not criminal.
