The FERS (Federal Employees Retirement System) rules for law enforcement allow an employee to retire at age 50 if he/she has 20 years of service. McCabe turns 50 tomorrow. He would have begun collecting his pension immediately had Sessions not fired him.

The default for FERS is what non-LEO employees get: They have to wait until age 56 years 8 months. If they retire early the pension is reduced according to a formula for each year of early retirement. So McCabe will have to defer his eligibility date for a few years before collecting 100% of his pension.

So to summarize, with two more days of federal service (as a LEO) McCabe can retire next week and begin collecting his pension immediately. Otherwise, he can elect to take a smaller pension or defer until shortly before his 57th birthday and collect his full amount.
