As for the scammer, he's not scamming but is just looking to hurt you. He has and will make money doing it. Hiring a hacker sounds good but legally you could lose everything
Trademarks are wise. I did it and got money when the moron used my domain name dot org. He lost his sites, money and I didn't gloat, just said it was the price of dishonest business practices. He had a lot of sites like that including stolen content.
Years ago I used a service that notified me when someone used my images without permission. People don't change image names sometimes. I forget the name but it was about $100/year which aid for itself from bills I sent. Hosts and ISPs were happy to dump dishonest customers back then
