It's a misdemeanor on the 1st attempt. Second time it's a federal crime. The people who are on a misdemeanor are in and out and re-united with their families in less than 24 hours, those who ask for asylum are made aware of the fact they will be separated through the process (likely) and chose to do that. Anyone else is committing a federal crime
