Doesn't matter. If he paid her to shut her up so she wouldn't affect the election, then he has to declare that money as being a campaign contribution and there are rules to how that must go down. At this point, it looks like it never was reported. Maybe it was. I'm sure Cohen is going to let us know one way or the other.
John Edwards used his own money to pay to keep his mistress quiet while he was running for President and when he got caught he ended up charged with five felonies because he didn't report it correctly. The only reason he didn't go to jail was because he was able to take the stand and convince the jury that he paid her to save his marriage not his campaign. Trump likely won't be able to make that same argument.
