He is taking the content from FHGs. If the sponsor provides FHGs for affiliates it doesn't mean he gives permission to copy the pictures and use them on your server as separate files - unless they explicitly state they do allow that. (from strictly legal point of view)

ZIPs are totally different case as they are directly offered for this purpose, though he said he scrapped the content off other websites (galleries).

Say the sponsor use licensed content and that licence doesn't allow them to make copies for third parties. Offering it on FHGs would be ok as the content stays on their site, but giving it away in ZIPs would not be OK - it would be prohibited use and therefore copyright infringement. See the difference? ...same for scrapping it by affiliates without permission.
